These Terms of Service (the Terms) govern your use of the TOSHPLANTS website, online store, products, and services. By visiting the website, placing an order, booking a service, or otherwise using the store, you agree to these Terms.

1. About TOSHPLANTS

TOSHPLANTS is an Ontario, Canada-based plant business offering live plants, plant-related products, and plant care services. Questions about these Terms or an order can be sent to toshplants@gmail.com.

2. Eligibility and account information

You must be legally capable of entering into a purchase agreement in your jurisdiction, or use the store with the involvement of a parent or legal guardian where required. You agree to provide current and accurate checkout, payment, billing, shipping, and contact information.

3. Products and availability

Products are subject to availability and may be changed, restocked, limited, or discontinued at any time. We make reasonable efforts to display product descriptions, photographs, prices, and availability accurately.

Live plants are natural, living products. Individual plants can vary in size, colour, variegation, leaf shape, number of leaves, growth pattern, and minor cosmetic characteristics. Where a listing states that the exact plant is shown, we will send that plant; where multiple plants are available, the plant received may vary naturally from the representative photographs.

4. Prices, taxes, and payment

Prices are shown in the currency presented by the store for your market, unless otherwise stated. Applicable taxes, shipping charges, and other charges are calculated or disclosed during checkout where required. Payment must be successfully authorized before an order is processed unless another payment arrangement is expressly offered.

We may correct genuine pricing or listing errors. If an error materially affects an order that you have already placed, we will contact you before proceeding whenever reasonably possible.

5. Orders

Submitting an order does not guarantee acceptance. We may cancel or limit an order when reasonably necessary, including because of inventory errors, suspected fraud, an incorrect price, an unavailable shipping method, a weather-related risk to a live plant, or another issue that prevents us from fulfilling the order as offered. If we cancel a paid order, the applicable amount will be refunded.

6. Shipping and local pickup

Shipping and pickup are governed by our Shipping Policy. Live plants are shipped within Canada using express shipping only. Other products may have different shipping choices. Local pickup may be available for eligible orders at the location displayed during checkout or in the order confirmation.

In cold weather, live plant shipments may include insulation and a heat pack. We may delay a live plant shipment during extreme weather when doing so is reasonably necessary to protect the plant.

7. Returns and refunds

Returns and refunds are governed by our Return & Refund Policy. TOSHPLANTS offers a 30-day return period for eligible physical products and live plants, subject to the procedures in that policy.

8. Plant care and plant services

Plant care information, consultations, Plant Doctor services, and other horticultural guidance are provided based on the information and plant condition available at the time. Plants are living organisms and outcomes can be affected by environmental conditions, pests, disease, prior care, water quality, light, temperature, humidity, and other factors outside our control. We therefore cannot guarantee a particular recovery, growth rate, or future condition of a plant.

Any service-specific booking, scheduling, cancellation, travel, or appointment terms displayed on the relevant service page or booking flow also apply to that service.

9. Website use

You may use this website only for lawful purposes. You must not interfere with the website's operation, attempt unauthorized access, misuse checkout or payment systems, introduce malicious code, scrape or copy the site in a way that violates applicable law, or use the site to infringe the rights of TOSHPLANTS or others.

10. Intellectual property

Unless otherwise stated, the TOSHPLANTS name, branding, original photographs, graphics, written content, guides, and other original store content are owned by or licensed to TOSHPLANTS and are protected by applicable intellectual property laws. You may not reproduce or commercially use that content without permission except where permitted by law.

11. Third-party services and links

The store may use or link to third-party services, including payment providers, carriers, booking services, review platforms, and other websites. Those third parties may have their own terms and privacy practices. TOSHPLANTS is not responsible for third-party websites or services that are outside our reasonable control.

12. Disclaimer and limitation of liability

To the maximum extent permitted by applicable law, the website, products, and services are provided without warranties beyond those expressly stated by TOSHPLANTS or required by law. TOSHPLANTS is not responsible for indirect, incidental, or consequential losses arising from use of the store, products, or services where such liability can legally be excluded.

Nothing in these Terms excludes, restricts, or limits any warranty, remedy, consumer right, or liability that cannot legally be excluded or limited.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without limiting any mandatory consumer protections that apply to you in your place of residence.

14. Changes to these Terms

We may update these Terms from time to time to reflect changes to the store, our services, or applicable requirements. The current version will be posted on this website with the updated date. Changes apply prospectively unless applicable law requires otherwise.
